RE: Petition for Executive Clemency | Petitioner: Michael C. Shirley (Case No: C330098)
Dear President Trump,
I am writing to respectfully but urgently petition for a full executive pardon or commutation of my sentence based on actual innocence regarding my July 27, 2023, conviction for conspiracy to commit honest services fraud and honest services fraud.
I was sentenced on February 27, 2024, to 87 months prison time plus an order of restitution in the amount of $536,402.33. I have no record of prior convictions and believe the sentence I received did not fit the crimes of which I was convicted.
I have maintained my absolute innocence from the moment of my surrender and through approximately two years of wrongful federal incarceration. It is abundantly clear to my counsel and I that the charges were opportunistically motivated by politics by the Department of Justice under President Joe Biden and manufactured by a desperate, suicidal, serial liar and fabricator to lessen his own sentence. This was obviously part of the larger effort to discredit your campaign for a second term and harm as many conservatives and Republicans as possible. In many of the documents presented to us in discovery the serial-liar witness of the Biden government invoked your name and those of other high-ranking Republicans. Of note, the Biden government's only witness pleaded the Fifth Amendment over 60 times. The Clinton-appointed judge over my case refused to make this key witness answer our questions, nor was he willing to strike him as a witness.
My attempts at appealing the conviction have been unsuccessful, despite our best efforts to point out the numerous irregularities of the original (2023) trial and a Supreme Court ruling around the same time which highly criticized the misuse of honest services fraud as a charge (Percoco v. U.S., 2023). An earlier attempt to find me guilty of a bribery and kickback scheme fell apart during trial. Sadly, other false assertions and novel legal theories persisted in court and continue to harm my public reputation, including two related, injurious press releases from the Biden DOJ.
Mr. President, I appeal to you as someone who knows well the sting of lawfare and how easy it is for others to downplay and dismiss you because of it. I was targeted because they believed me to be weak and lacking the resources to fight back. They were wrong because I have the resolve to fight! I refused to be a part of a scheme to undermine our Republic in order to help an aging, mentally incapable, and the Senate's historic No. 1 numbskull – Joe Biden – keep the White House.
I also appeal to you as a father and fellow entrepreneur. My family, including mother and father, have severe health complications which require my ability to earn an income. Prior to my incarceration my career has been dedicated to electing candidates who champion liberty and America First principles such as yourself. My list of former local, state, and federal clients and employers is extensive. I am eager to rebuild my business, my family's health, and our country as soon as possible.
In the meantime I have maintained an exemplary disciplinary record during my time at FCI Miami Camp. I have worked in numerous roles requiring a high degree of trust such as inventory for dining services and driver.
